STORE REGULATIONS

I.Definitions


1. Regulations – these regulations, regulating the principles of using the service.
2. Store – online store run by the Seller at www.3dcustoms.pl, through which Users can purchase goods available in the store.
3. Seller – 3D Customs Przemysław Kozioł, 35-222 Rzeszów, al. Generała Leopolda Okulickiego 20, lok. C10 NIP: 7382165760, e-mail: sklep@3dcustoms.pl
4. Digital content – ​​digital files available for download after receiving payment by the store or virtual content to be played on the website of the service to which the User will receive access after receiving payment by the store. Digital content is not recorded on a material medium. 5. User – any entity using the services of the Website operated at www.3dcustoms.pl
5. Consumer – a natural person purchasing goods available in the store for purposes not directly related to their business or professional activity.
6. Consumer-entrepreneur – a natural person conducting business activity, entered in the CEiDG, purchasing goods available in the store for purposes not directly related to their business or professional activity.
7. Entrepreneur – a company, institution or natural person making a purchase for profit, professional or directly related business purposes.
8. User account – a service provided free of charge electronically by the Seller, allowing the User to use additional functionalities of the Website.
9. Website – the website on which the Store operated at www.3dcustoms.pl is located11.Towar – produkt lub usługa oferowane do sprzedaży w sklepie.

II.General provisions


1.These regulations indicate the rules and conditions of using the services of the website for the benefit of Users, which include in particular:
    a) sale of goods, i.e. products and services via the Internet - a paid service
    b) setting up and maintaining a user account on the website - a free service
2. The range of goods offered via the website includes accessories and automotive parts.
3. Information and description of the products offered and services provided are provided by the Store with each product on the website www.3dcustoms.pl
4. Each User can contact the Seller via e-mail by sending a message to sklep@3dcustoms.pl or by phone at 510 667 633.
5. Access to the services of the website may be limited or impossible in the event of maintenance work on IT systems or failures beyond the Seller's control. At the same time, we will make every effort to ensure that such difficulties occur as rarely and as quickly as possible. 6.Any irregularities related to the functioning of the Service, Store, User Account should be reported via the "Contact" form on the store's website, to the email address sklep@3dcustoms.pl or by phone at 510 667 633.
7.The content published by Users on the Service, such as comments, ratings, reviews, statements, are their private opinions.
8.Users are prohibited from providing content of an illegal nature.

III.Receiving and processing orders


1. The User places an order for a product or service directly on the Store website www.3dcustoms.pl or via www.facebook.com/3dcstm.
2. During the ordering process, the User has the option of creating a User Account that gives them access to additional functions.
3. In the order form, the User fills in the data necessary for shipping and performs:
    a) selection of the product or service,
    b) selection of the delivery method,
    c) selection of the payment method.
4. After placing the order, a message is sent to the e-mail address provided by the User with information about the placed order.
5. The Store fulfills the order after receiving payment for the ordered goods. The exception is the situation when the goods are sent cash on delivery, in which case the order is fulfilled immediately after it is placed.
6. Failure to make payment by the User within 7 days, i.e. failure to pay for the goods, will result in the order being canceled
7.The User's order will be fulfilled provided that the goods are available in the warehouse or from the store's suppliers.
a)partial lack of goods in the order - when the missing goods are part of a larger order, the User is informed about the shortages and decides to partially fulfill the order or cancel the entire order. The refund in the case of prepayment is made in part or in full in accordance with the User's decision. The refund in the case of prepayment is made within a maximum of 10 days of the order being canceled.
b)complete lack of goods in the order - when the goods are unavailable in the warehouse or from the store's suppliers and it is not possible to fulfill the order, the User will be informed about this fact. The refund in the case of prepayment is made in full within a maximum of 10 days of the order being canceled.
8. After verifying the order, a message will be sent to the email address provided by the User with information regarding:
    a) confirmation of order acceptance, which is tantamount to concluding a sales agreement,
    b) lack of part or all of the order due to lack of goods,
    c) inability to complete the order due to lack of payment.
9. The sales agreement is concluded upon delivery to the User of an email containing confirmation of order acceptance.
10. A proof of purchase is issued for each order. After the User selects the appropriate option and provides the necessary data, a purchase invoice is issued for the order.
11. Until the order is completed, i.e. until the goods are sent for shipment, the User may make changes to the order, including withdrawing the entire order.
12.To make changes to your order, please contact the store by sending an e-mail message to sklep@3dcustoms.pl or by phone at 510 667 633.
13.Order modifications in the scope of: shipping address, overpayment refund order can only be submitted in writing via the "Contact" form on the store's website or via e-mail to the address: sklep@3dcustoms.pl

IV.Online store payment terms and delivery costs


1. The prices of goods in the online store are given in Polish zloty and include applicable taxes. 2. The Seller is a VAT payer and issues invoices including VAT. 3. Each product has its own price and this price is binding at the time the User places an order. 4. The Store has the right to:
    a) change the price of goods in the Store,
    b) introduce new goods and remove goods from the Store's offer,
    c) conduct and cancel promotional campaigns on the Store's websites,
    d) make changes to the Store's promotional offers. 5. The rights described in the above point do not affect the prices of goods purchased and ordered before the promotional offers or changed prices come into effect. 6. The following payment methods are available for ordered goods with delivery to Poland:
    a) cash on delivery
    b) cash (upon personal collection)
    c) electronic transfer
    d) traditional bank transfer
    e) credit/debit card payment
    f) BLIK payment
7. We reserve the right to block some payment methods for selected products.
8. We reserve the right to disable the "cash on delivery" method for Users who have not received two consecutive shipments paid on delivery. This payment method will be unblocked after placing and receiving another order with an electronic transfer or traditional bank transfer as payment method.
9. The User bears the costs of delivery of the ordered physical goods.
10.After selecting the goods and the shipping agent, the basket will automatically calculate the delivery costs.
11.In the case of purchase of virtual products and digital content, there are no delivery costs.
12.In the case of personal collection of goods, there are no delivery costs.

V.Deadlines for completion


1. Each product description includes the estimated time of preparing the order for shipping or delivery in the event that the User selects the "personal collection" option, which indicates the period from accepting the order to sending the package from the store or to personal collection by the User. This time is indicated in business days.
2. In the case of ordering several products, the shipment is sent or issued when all the goods are completed. The date of shipping or personal delivery of the goods to the User is determined based on the goods with the longest delivery time.
3. The User independently selects the shipping intermediary (courier, post office, parcel lockers). Each intermediary declares its own maximum delivery time indicated in the description.
4. The User is responsible for any delays or failure to deliver the goods caused by an incorrect or inaccurate address provided by the User.

VI. Right of withdrawal


1. The Consumer/Consumer-entrepreneur may withdraw from the Agreement within 14 days of receiving the goods without giving any reason. The exception are products and services prepared individually for the Consumer/Consumer-entrepreneur, made to special order.
2. The Entrepreneur does not have the right to withdraw from the agreement.
3. The declaration of withdrawal from the agreement must be sent in writing to the email address sklep@3dcustoms.pl, whereby the day of submitting the declaration of withdrawal from the agreement is considered to be the day of sending the declaration. The declaration must be sent before the expiry of 14 days from the date of receipt of the goods.
4. The return of goods is only possible if the goods have not been used, copied or damaged in any way. The returned goods must be complete (they cannot be devoid of hangers, labels). The returned goods should be sent back together with the proof of purchase received with them or other proof confirming the purchase of the returned goods in our store (e.g. confirmation of payment for the goods, e-mail confirming the purchase of the goods), with the note "Return".
5. The returned goods should be sent to the store immediately, no later than 14 days from the date of withdrawal from the contract. The store does not accept cash on delivery.
6. The goods should be returned to the following address: Al. Generała Leopolda Okulickiego 20, lok. C10 (1st floor, premises called "Rzeszowskie Centrum Technologii 3D"), 35-222 Rzeszów.
7. The Store shall refund the payment for the goods immediately, no later than 14 days from the date of receipt of the declaration of withdrawal from the contract by the Consumer/Consumer-entrepreneur, provided that during that time the Consumer/Consumer-entrepreneur returned the goods to the Store. The refund is made using the same payment methods that were used by the Consumer/Consumer-entrepreneur when making the purchase, unless the Consumer/Consumer-entrepreneur has expressly indicated another form of refund.
8.The Consumer/Consumer-entrepreneur receives a refund of all costs incurred by him, including the costs of delivering the goods in the amount of the cheapest shipping method offered by the store.

VII. Complaints


1. The Seller is obliged to deliver goods free from defects to the User. 2. In the event of a physical or legal defect in the goods purchased in the Store, the User has the right to make a complaint based on the provisions on warranty on the principles set out in the Civil Code. 3. The complaint should be sent in writing to the email address sklep@3dcustoms.pl or by traditional mail to the address Al. Generała Leopolda Okulickiego 20, lok. C10 (1st floor, premises called "Rzeszowskie Centrum Technologii 3D"), 35-222 Rzeszów, along with information on the type and date of occurrence of the defect. 4. Actions that the User may take in the event of a defect in the goods:
    a) Submit a declaration of a reduction in the price of the goods or withdrawal from the contract, unless the Store is able to replace the defective goods with goods free from defects without excessive inconvenience to the User. If the product defect is insignificant, the User may not withdraw from the contract.
    b)The User may request the replacement of the product with a defect-free one or the removal of the defect in accordance with the specific principles of the Civil Code.
5.Within 14 (fourteen) days of receipt of a valid complaint, it will be considered by the Store, and the User who submitted it will be informed of the Store's position, via e-mail sent to the e-mail address provided by the User and used by the User for correspondence in connection with the Store's services.
6.The Seller and the User will make every effort to resolve any disputes amicably, in particular through negotiations.

VIII. User account in the system


1. Each User has the option of creating a free, voluntary user account on the website, which gives the possibility of using additional store functionalities such as: checking the order status, viewing order history, editing User data in the Account independently, as well as participating in the Loyalty Program.
2. Account registration in the system cannot be done using services such as: Facebook, Google.
3. A User Account is created by filling out the appropriate registration form on the Website.
4. To use the User Account, a device with a web browser that supports cookies, with access to the Internet and an active email account is required.
5. At the time of registration (creation of the User Account), an agreement is concluded between the User and the Seller to maintain the User Account on the terms specified in these regulations. The agreement is concluded for an indefinite period.
6. The User may resign from the User Account at any time, without giving a reason and incurring any costs. For this purpose, the User should send his/her resignation to the Website at the following e-mail address: sklep@3dcustoms.pl, which will result in immediate deletion of the User Account and termination of the agreement in this respect.

IX. Technical conditions


1.In order to use the Service, it is necessary to meet certain technical requirements:
    a) Active e-mail account;
    b) a device connected to the Internet and an installed web browser;
    c) acceptance of cookies enabled in the web browser used by the device;
    d) JavaScript support enabled in the web browser used by the device.
2. The User should use the appropriate browser that works with their device

X. Personal data and cookie policy


1. The Service Provider is the administrator of personal data provided by the User when using the Website.
2. The User's personal data are processed on the basis of a contract and for the purpose of its implementation and on the basis of consent, on the principles specified in the General Data Protection Regulation (GDPR). Detailed information on data processing by the Service Provider is included in the privacy policy posted on the Website.
3. When using the Website, please consent to the use of cookies in accordance with the Privacy Policy. If you do not agree to our use of cookies, you can change your browser settings in an appropriate manner or opt out of using the Website. Information on cookies used on the website can be found in the privacy policy on the website.

XI. Final provisions


1.The sales agreement and the agreement for the provision of electronic services are concluded between the User and the Seller.
2.The products and services placed on the Store's websites do not constitute an offer within the meaning of the Civil Code.
3.In matters not regulated in these Regulations, the provisions of generally applicable law, including the Civil Code, as well as the provisions of the Consumer Rights Act, shall apply.
4.In the event of disputes arising from the sales agreement, the competent court is the court with jurisdiction over the defendant's registered office or the court with jurisdiction over the place of performance of the agreement.
5.When resolving disputes, the User has the option of using the ODR Platform - an interactive website that is a single point of access for consumers and Sellers wishing to resolve a dispute out of court (ODR - Online Dispute Resolution). Through it, you can file a complaint regarding goods or services purchased online, both domestically and abroad. This is done by filling out an electronic form and finding the appropriate entity that will resolve the dispute. All institutions listed on the platform have been verified to ensure that they meet the relevant regulations and are registered by national authorities (in Poland, this is the Office of Competition and Consumer Protection). The website is available in all EU languages, and also allows you to attach relevant documents and translate them. 6.The Seller reserves the right to make changes to these Regulations at any time.
7.If the Seller makes changes to the regulations, they will be made available on the Website in a uniform form.
8.The new Regulations enter into force on the date of their publication on the Website and cover services provided by the Website from the date of their publication.
